The nature and scope of services will be defined on a case-by-case basis and confirmed through email or a written agreement.
2. Client Responsibilities
Clients engaging AK Consulting agree to:
- Furnish accurate, complete, and timely information and documentation required for the service engagement.
- Review deliverables, filings, and reports in a timely manner and notify us of discrepancies or clarifications.
- Comply with agreed timelines for approvals, document submissions, and other client-side responsibilities.
AK Consulting shall not be held liable for delays or inaccuracies arising from client-side omissions, delays, or incorrect information.
3. Engagement and Onboarding
A service engagement shall be deemed to begin once the scope, timelines, and fees are mutually agreed upon via email or written communication.
In cases of recurring or retainer-based services, a formal onboarding and agreement process will be initiated.
AK Consulting reserves the right to refuse or discontinue service to any client at its discretion, especially in the event of non-cooperation, unethical behaviour, or misuse of service.
4. Payment Terms
All services are billed as per agreed terms, and fees are payable in advance unless otherwise specified.
Invoices are typically issued via email or Zoho Billing.
Delayed payments beyond the due date may attract a late fee or suspension of service until dues are cleared.
Once services commence, fees are non-refundable, except in cases of duplicate or erroneous payment.
5. Confidentiality
AK Consulting maintains strict confidentiality of all client information, documentation, and communication. We do not disclose any client data to third parties, except:
- As required under law or legal process;
- To trusted third-party service providers (e.g., Zoho) for service delivery under strict confidentiality obligations.
6. Data Security
We adopt industry-standard technical and administrative security measures to protect your data. However, AK Consulting shall not be held liable for any security breach caused by force majeure, cyberattacks, or third-party compromises beyond our control.
7. Use of Third-Party Platforms
We use secure third-party platforms, including Zoho, for CRM, document management, communication, and workflow automation. By engaging with us, you consent to the use of such platforms in the delivery of our services.
8. Intellectual Property
All materials on the AK Consulting website, including logos, content, documents, and designs, are the intellectual property of AK Consulting. No part of the website or its content may be copied, reproduced, or reused without written permission.
9. Disclaimer of Warranties
AK Consulting provides services on a best-effort and professional basis. We do not guarantee:
- Success of any statutory registration or approval;
- Acceptance of filings or tax positions by regulatory authorities;
- Any financial outcome from our advisory, unless specifically committed under a written agreement.
10. Limitation of Liability
To the fullest extent permitted by law, AK Consulting shall not be liable for:
- Indirect, incidental, or consequential damages;
- Errors or omissions arising from client-provided information;
- Delay in service due to technical issues, third-party delays, or force majeure events.
11. Termination of Services
Either party may terminate services with written notice. Upon termination:
- All outstanding invoices must be settled immediately.
- Access to ongoing services or deliverables will be revoked.
- No refunds shall be made for services already rendered or partially completed.
12. Governing Law and Jurisdiction
These Terms are governed by the laws of India, and any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Puducherry, India.
13. Amendments
We reserve the right to amend these Terms at any time. Changes will be updated on our website, and your continued use of our services constitutes acceptance of such updates.
